The IRS Fresh Start Program offers these options:Installment Agreement, Partial Payment Installment Agreement, Currently Non Collectible, and Offer in Compromise, and First Time Penalty Abatement.
Your financial ability will determine the programs that you can qualify for. If you have the ability to pay your debt, the IRS will not allow you to enter any hardship programs. You will only qualify for an Installment Agreement (also called a Streamline Installment Agreement). They will usually divide your total debt to the IRS by 72 months (6 years). It can be less than 72 months if you pay more than the minimum monthly payment. Also your future refunds (hopefully you have changed your withholdings so you don’t owe each and every year) will be applied to your IRS debt so this can shorten the length of the time you pay.
You will not be only saving time but you will also be saving money. The IRS will ALWAYS charge interest and penalties until your IRS debt is paid off. Like a credit card. So we always encourage our clients that have the financial ability to pay, to pay more than the monthly minimum.
This option is a hardship program that utilizes the CSED (Collection Statute Expiration Date) dates of the tax years you owe. The PPIA lets you pay a monthly payment that you CAN AFFORD until the CSED expires. The CSED is 10 years from the date that particular tax year first got assessed. The 10 years start from that date.
So for example, you owe $30,000 to the IRS. You can only afford $50 a month because your income barely meets your expenses. And to keep it simple, let’s say it’s only one year that you owe and your CSED expires in 7 years. So you will be paying $50 a month or $600 a year. Over 7 years, you will be paying $4,200. This is considerably less than the original $30,000 that needs to be paid.
You have to be in a hardship for this meaning that after your basic expenses, your income barely covers or falls short of paying your basic expenses.
This option is a hardship program where the IRS will stop all collections and will not require any payment at the moment. The IRS considers this option “Temporarily delay of the collection process.
” Not only this, but your debt WILL increase because penalties and interest will continue to accrue until you pay the full amount. During this “Temporary delay”, the IRS will review your ability to pay every year or 2. Also, there is a great chance that they will file a Notice of Federal Tax Lien.
This option is okay but we feel the better option (if you want to eliminate your tax debt, rather than increase your tax debt) is a Partial Payment Installment Agreement.
This is a hardship program where the IRS allows you to settle your tax debt for less than the full amount you owe. According to the IRS:
An offer in compromise allows you to settle your tax debt for less than the full amount you owe. It may be a legitimate option if you can't pay your full tax liability or doing so creates a financial hardship.

We generally approve an offer in compromise when the amount you offer represents the most we can expect to collect within a reasonable period of time.
You have to be in a financial hardship to qualify for the Offer in Compromise. You also cannot have any assets.
